Dual Use and commercial goods being exported from the United States are controlled by the Department of Commerce (DOC) through the Export Administration Regulations (EAR).
EAR use the Commercial Control List (Supplement No. 1 to Part 774 of the EAR) (CCL) to control and classify most commercial or ‘dual use’ items.
CCL classifications are stated as an Export Control Classification Number ECCN, followed by the classification code.
Andor Technology currently has the following classifications under the CCL.
ECCN 6A003.b.3
Imaging cameras incorporating image intensifier tubes having the characteristics listed in 6A002.a.2.a. or 6A002.a.2.b.;
6A002.a.2.a.
Image intensifier tubes having all of the following:
1. A peak response in the wavelength range exceeding 400 nm but not exceeding 1,050 nm;
2. Electron image amplification using any of the following:
3. Any of the following photocathodes:
ECCN 6A203.b.2
Cameras and components, other that those specified in 6A003, as follows: Other framing tubes and solid-state imaging devices having a fast-image gating time of less than 50 ns.
iXon Family
EM Newton - DU970, DU971
Luca Family
Surcam
EM Classic
OCAM² Family
ECCN 6A003.b.4.c.
Imaging cameras incorporating "focal plane arrays" having any of the following:
a. Incorporating "focal plane arrays" specified in 6A002.a.3.a. to 6A002.a.3.e.;
b. Incorporating "focal plane arrays" specified in 6A002.a.3.f.; or
c. Incorporating "focal plane arrays" specified in 6A002.a.3.g.;
6A002.a.3.g.
Non-"space-qualified" "focal plane arrays" having all of the following:
1. Individual detector elements with a peak response in the wavelength range exceeding 400 nm but not exceeding 900 nm;
2. Specially designed or modified to achieve 'charge multiplication' and having a maximum "radiant sensitivity" exceeding 10 mA/W for wavelengths exceeding 760 nm; and
3. Greater than 32 elements.
C-RED Family
6A003.b.4.a
Imaging cameras incorporating "focal plane arrays" incorporating "focal plane arrays" specified in 6A002.a.3.a. to 6A002.a.3.e.
6A002.a.3.c
Non-"space-qualified" non-linear (2-dimensional) "focal plane arrays" having individual elements with a peak response in the wavelength range exceeding 1 200 nm but not exceeding 30 000 nm.
Note: “Technology” associated with the design, production and repair of the above products is also controlled under the following Dual List entries, and therefore also requires an export licence if from the US.
6E Technology
ECCN 6E001 "Technology" according to the General Technology Note for the "development" of equipment, materials or "software" specified in 6A, 6B, 6C or 6D.
ECCN 6E002 "Technology" according to the General Technology Note for the "production" of equipment or materials specified in 6A, 6B or 6C.
"technology" means specific 'information' necessary for the "development", "production" or "use" of "goods" or "software";
EAR 99
Unclassified products
If your item falls under U.S. Department of Commerce jurisdiction and is not listed on the CCL, it is designated as EAR99.
EAR99 items generally consist of low-technology consumer goods and do not require a license in many situations.
However, if you plan to export an EAR99 item to an embargoed country, to an end-user of concern or in support of a prohibited end-use, you may be required to obtain a license.
Once it has been established that the product is included in the CCL (above), the exporter must cross reference the “reasons for control” listed under the CCL entry with the country specific entry listed in the Country Commerce Chart (Supplement No. 1 to EAR Part 738), (CCC), which will establish whether a licence is needed to export to that destination.
i.e. where an X appears against the country of destination on the Commerce Country Chart in any of the columns showing the “reasons for control” specified under the product classification on the CCL, the product is controlled and therefore requires a licence.
Andor Classification Specific
ECCN 6A003.b.3 + 6A003.b.4.c
The reasons for control for this classification stated on the CCL are National Security (NS), Nuclear Non-Proliferation (NP), Regional Stability (RS) and Anti Terrorism (AT).
ECCN 6A203.b.2
The reasons for control for this classification stated on the CCL are Nuclear Non-Proliferation (NP) and Anti Terrorism (AT).
EAR 99
Products of this classification can be shipped under NLR to most destinations, except those with US Sanctions.
Export Licence Applications
Where required export licence applications under EAR are made via the Simplified Network Application Process Redesign (SNAP-R) system via the Bureau of Industry and Security page on the Department of Commerce Website.
Where you are exporting the above products from the US it is your responsibility to familiarize yourself with the applicable regulations and ensure that the appropriate license has been applied for/received from the US authorities prior to shipment.
